at 54 peralta avenue for construction of a driveway ramp. >> sponsor is david chiu and from dpw we have david qwan >> my name is eleanor tapk and i am with the department of public works. our office received a major encroachment request from sia consulting on october 26, 2011. the request is to remove and reconstruction a portion of the city-owned maintaining wall to construct a concrete driveway ramp with transition slope to conform to the existing sidewalk grade in order to provide vehicle access to the property at 54 peralta. we have reviewed project, the project has been routed to city planning for them to review on the conformity to the general plan and we receive a letter from them in december 12, 2011, stating that the project conforms to the general plan. we also referred the project to transportation advicery staff committee for them to review and they approved the project on march 22nd, 2012. the project subsequently referred to our department, structural section, hydraulic section, and to the disability sf (inaudible) for their review and they approved the project. we condu
dpw and cal train committed to incorporate landscaping to enhance both those projects. lastly, we have heard consistently from the community, the importance of incorporating a local job opportunities and contracting opportunities and so this funding request includes a request for developing an outreach strategy to go out and engage folks in the community so they can participate in the opportunities that will be available with both of these projects. given the work we've done and the community outreach, we are essentially, i think we kind of presented this conclusion or rather thinking on it initially but further work has essentially found that the option one, the berm option combined with the connector road really are not ideal are the best options we have in terms of maintaining that bridge with the funds we have in terms of facilitating a station and maintaining local access. and in terms of facilitating other land use activities in the area. those include the pc but go into a little more detail. we also included in this package of improvement and city project for the connector road
is to provide funding for the next phase of connector road design. that includes allocating prop k funds to dpw which will be leading the 30% design effort for the connector road. that includes environmental review as well as starting right at negotiation. the purpose of that is to get more clarity to the schedule and make sure the connector road can move forward in parallel with the bridge replacement project. really make sure we're minimizing that construction overlap period. lastly to appropriate prop k funds to the authority to continue working on planning and project oversight as well as conducting further rounds of outreach to go into the community with the work that we're going to be doing and providing some answers to the community in the spring before we come back to the board. finally that authority piece does include that local business robust outreach strategy to make sure people are aware of and can participate in those contracting opportunities. we'll come back to the community and back to the board in the spring with remaining questions in terms of design, schedule and what the
presented now. dpw initial application for this project included repaving work on 9th street and brian to 8th to 11th. dpw staff informed us the brian street segment will need two repairs. the schedule for this work is to be determined and dpw staff anticipate funding this segment with future gas tax, prop k or other available funding. we've kept the full amount program at dpw request. next is dolores. the draft we did bring you to in december. the project, dpw submitted dolores street pavement that project includes pedestrian enhancement. scheduled for construction in the fiscal year '14 and '15. there wasn't enough -- after funding higher ranking project, there weren't enough prop double a funds to fund all the eligible projects. the condition associate with this action, the condition which has been agreed to by dpw to fund the long street project unless dpw secures other funds. district six, safety projects. we recommended funding for two pet safety projects located in district six. one is mid clock crossing. it was identified in the neighborhood transportation plan. several of the trea
noticed but i'm just wondering how dpw generally follows up with residents with these concerns. i think there is some comments made that the department's hearing was in june and that the first they had learned of this kind of was a few days ago, but i'm just wondering what's your general process of following up with residents. >> thank you, commissioner. thank you, supervisor. normally what happens is usually within 30 days of a hearing, we would provide a finding or notification to all the people who attended that hearing. in this specific case, because there was additional review required, it delayed -- without that information we could not make a final decision and that delayed it. we were unable until approximately early to mid-november to generate the final finding in this case and i think it became a timing issue of getting it to the citizens and the people who were at that hearing and then as it relates also to supporting this to this board at this point, but we normally do try to inform the people at the hearing and the applicant within 30 days or once a decision has been made
with the dpw they say it's still up for discussion. and they won't really give us a clear answer. it's been really frustrating and affected our business dramatically from where we can operate. that is one thing. then other thing i wanted to touch upon. there is a big common misconception that many people in restaurant associations and in building management have been making about that food trucks are not healthy. that is a big misconception about what current food trucks are able to produce. we are an indian food truck, punjabi and half of our menu is vegetarian and vegan. very healthy for you. so i think they are just kind of slowing stones to knock us down. that has been a little upsetting. if you look at the true ethnicity of all healthy food that have come out of the food trucks from filipino, vietnamese and korean, it's a healthy option for people in san francisco that is really a food capital of this nation and it's really welcoming and something that people should be aware of. thank you very much. >> thank you very much. >> next speaker. >> good afternoon commissioners. my name i

costs up front after two years of paying my permit and paying in excess of 2,000, dpw informed me the police department committed an error. it was in violation of the municipal police code. dpw senior managers waived the nee on a new location but couldn't approve a refund. the claim was dean nied. michelle wu, the hearing officer, dpw, gave me the option to finish out the year at dolores park or choose a new location. many of the prime locations have been occupied over the years, and the new regulation doesn't require you to pay a $10,000 fee. do you think the city has given me back the money? and to this day, i still don't have a comparable location. mistakes happen and that's why i wasn't seeking additional damages. i just wanted the money back that i paid. i realize each of you are extremely busy. i know you have to choose which issues to get involved in. remember which issues you also ignore speak volumes of your character. i can only hope these things from a leader that you feel this is important in maintaining high ethics, that you see the importance of taking action for sma
, of course, our dpw department. i want to thank the mayor and your commissioners for really helping to see this through. and i want to take a moment and thank the community. so many of you here are our merchants, are our members of labor, are our neighborhood leaders who have really come together. we see representatives from our hotels, folks who represent every type of business along in waterfront big and small. but for your support over the years, we wouldn't be here today. when i came in office four years ago, i was told by the constituents of these neighborhoods that we needed to invest in our waterfront. and four years later we're on the eve of cutting the ribbon for the explore atorium. * we just passed a bond measure that will bring two waterfront parks a few blocks from here. this won be possible but for the vision and the foresight that we all have about what we want a 21st century waterfront to look like. i want to thank you for that. i don't see any of my colleagues here. i'm going to say the following. i think this may be the most beautiful vista vantage points not just in san
of tons of appeals of dpw food truck permits to the board of appeals and i got involved to see if we could broker some sort of peace to make sure everyone could go forward and the food scene could continue to thrive in san francisco. i convened a couple different working groups working with business owners, restaurant owners, food truck operators, and then also with san francisco unified school district and school lunch advocates. our goal being to come up with a fair and transparent set of rules for this area. based on more than a year's worth of work i recently introduced this group -- this package of legislation, that i think moves us in the right direction. the legislation has five parts. the first has to do with the distance between food trucks and brick-and-mortar restaurants. there is the very first time to my knowledge we have ever had a mandatory buffer zone in between food trucks and brick-and-mortar restaurants. there has been discretionary consideration of the number of feet, but never had it mandated. instead it was a discretionary 300' buffer. this legislation will do two t

to say. we're here -- we got the appeal from the dpw and we were asked to do some things. we distributed keys and went with the hours of operations and applied for the property building permits that the department of building inspection and went through planning. so we have got gone through the dpw, dbi approved the plans. we haven't quite got it all signed off because we were told to stop on it somewhere along the line when the dbi permit got approved. we did the load studies for the people coming and going and access and push bars and the keys. so it's pretty easy to walk in and out of the door, it works and it can be accessible, if it needs to be. i'm not sure how you would get a wheelchair in the building once it's in there, but it's not a problem. we have to do something with the grade there, but we haven't finished a lot of this stuff and somebody was talking about the structure. we haven't completed it because we were told to stop on it. which they are all pretty simple things to complete, the structure. i think it's a good thing for the building. it keeps them clean
